What is GDPR?
GDPR stands for General Data Protection Regulation (Regulation (EU) 2016/679) and is a regulation by which the European Union seeks to strengthen and unify data protection for all individuals within the European Union (EU). GDPR sets guidelines for the collection and processing of personal information of individuals within the EU. It enters into force on 25 May 2018.

Why GDPR?
In an increasingly digital world, the aim of the new regulation is to ensure more protection to individuals for the collection and processing of their personal data.
GDPR therefore seeks to:
- harmonise the treatment of personal data across the EU
- ease personal data flow throughout the 28 EU member states
- catch up with the significant increase of Digital communications , such as social media
- extend the rights of data subjects
- make privacy by design the norm.

How is personal data defined under GDPR?
Personal data means any information (such as name, ID number, location data, email address etc) which allows an individual to be identified directly or indirectly. The new regulation now requires that individuals have a fair lawful and transparent treatment of their personal data by companies and that they have a number of rights in relation to this data.
GDPR also includes specific requirements for the processing of special categories of personal data or sensitive data. This includes categories such as racial or ethnic origin, political opinion, religious belief, health information …

What are the data subject’s rights under GDPR?
Data subjects have the right to receive clear and understandable information about:
- Who is processing their data
- What data is being processed
- What is the purpose of processing their data
They also have the right to request access to their personal data held by an organisation to correct it if needed and to restrict the processing of their data.
They can also request that their current service provider transmits, or not, their personal data to another service provider eg. when switching from one internet social network to another.
They also have the right to be forgotten which means that the data subject can ask for their personal data to be deleted if they no longer wish for it to be processed and where there is no legitimate reason for the company to keep it.
